Note issued by EMAK S.p.A: pursuant to article 13 of European Regulation 2016/679

Whereas

1) following your visits to this website, the compilation of forms, the establishment of preliminary contacts and, if applicable, of commercial relationships, our company will collect and process your personal data.

2) we hereby specify, in the interest of full disclosure, the following definitions contained in European Regulation 2016/679:


 

Personal data: means any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person;

Processing: any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

Now, therefore, pursuant to article 13 of European Regulation 2016/679,

we hereby inform you

that your personal data can be collected and processed by this company in compliance with the following provisions:

  1. general purposes: the data will be processed to optimize the management of the activities deriving from the compilation of the forms present in the various sections of our website, to fulfill your requests/answer your queries, to manage any commercial relationships with you now and in the future, for the correct fulfillment of any bureaucratic, accounting, tax and administrative requirements and for the company activities that are mandatory by law and in any case strictly related to the ongoing relationships;

  2. “direct marketing” purposes: your data (but not sensitive/particular data) may also be used, only and exclusively subject to your free, optional, express and explicit consent, revocable at any time, also to send advertising material/communications by e-mail, telephone, text message and similar means. After having provided your consent, you are in any case entitled to refuse, at any time and at no cost, the processing of your data for the aim set down in this paragraph;

  3. “profiling” purposes: your data (but not sensitive/particular data) resulting from the compilation of our forms/information sheets or that can be gathered from the type of purchases you have made, may be used, only and exclusively subject to your free, optional, express and explicit consent, revocable at any time, also to identify and define your tastes, preferences, habits, needs and consumer choices (so-called “profiling”). After having provided your consent, you are in any case entitled to refuse, at any time and at no cost, the processing of your data for the aim set down in this paragraph;

  4. methods: the data will be processed using hard copy/computer/telecommunications tools/media, in full compliance with legal requirements and in accordance with the principles of lawfulness and fairness and in such a way as to protect your privacy;

  5. optional conferment: the conferment of personal data is at your own discretion and is not mandatory;

  6. consequences of a potential refusal: refusing to provide the data or fully objecting to their processing for the purposes described at point a), may make it impossible to fulfill/answer some of your requests and/or queries and to manage any commercial relationships with you now and in the future. Instead, refusing to allow your data to be used for the purposes described at points b) and c), will have no consequences on your ongoing commercial relationships or on your entitlement to benefits linked to promotions;

  7. parties or categories of parties (recipients) to whom the data can be communicated or disseminated: the data can be communicated to third parties to comply with laws or legal obligations deriving from the ongoing relationships. If necessary, they can also be communicated to retailers outside the company, only and exclusively for the purpose of optimizing the management/shipment of any orders passed by you now or in the future. The data will not be disseminated under any circumstances;

  8. persons authorized to process personal data: your data will be processed only and exclusively by a small number of company employees in the administrative, marketing, sales and data center sectors, who are specifically authorized to do so;

  9. automated decision-making processes: no automated decision-making processes are managed; regarding “profiling”, please see point c) above;

  10. data subject’s rights: you have all the rights ratified by European Regulation 2016/679, namely the right to request access to your personal data, the right have them corrected or deleted, the right to have the processing restricted, the right to object to their processing, and the right to data portability. You also have the right to submit a complaint to the supervisory authority;

  11. transfer to third countries: any transfers of personal data to a third country outside the European Union or to an international organization will be made based on an adequacy decision taken by the Commission or, in case of the transfers described in articles 46, 47 or 49, second paragraph, of the European Regulation, based on appropriate, opportune guarantees;

  12. data retention period: the data will be stored for the period of time strictly necessary to fulfill the data subject’s requests, or based on the provisions of the laws in force or any contractual clauses;

  13. data controller: the data controller is the company that is the author of this note, namely Emak S.p.A., with registered office in Bagnolo in Piano (RE), via E. Fermi 4, in the person of its pro tempore legal representative;

  14. Data protection officer (DPO): The company has designated a DPO pursuant to art 37 GDPR, who can be contacted for information request or clarifications at the following address: dpo@emak.it

 

This information notice may be supplemented with additional elements and indications, provided verbally or in writing, in order to provide the fullest possible response to any further information you may require about privacy matters and to comply with regulatory changes.
